Where it would be unfair to try the accused or, put another way, where a stay is necessary to protect the integrity of the criminal justice system – This is where the Court considers that the accused should not be standing trial at all, irrespective of the potential fairness of the trial itself.Where the court concludes that the accused can no longer receive a fair hearing - This focuses on the trial process itself. In Crawley EWCA Crim 1028, the Court of Appeal clearly set out the scope of the two potential limbs that a stay for abuse of process can be brought under: In respect of delay (see below), the Court of Appeal have held that once the issue of delay had been raised it was for the prosecution to satisfy the court that a fair trial was still possible - R v S Stephen Paul EWCA Crim 756. 116.Īs a general principle, if the argument refers to the first limb of abuse, it will normally be necessary for the defence to prove not only that an abuse has taken place but that the accused has been prejudiced in the presentation of his or her case as a result, so that a fair trial is no longer possible. 78 R v Great Yarmouth Magistrates ex parte Thomas Crim. The essential focus of the doctrine is on preventing unfairness at trial, through which the defendant is prejudiced in the presentation of his or her case.Ĭourts that are asked to exercise their inherent power to stay should first consider whether other procedural measures such as the exclusion of specific evidence or directions to the jury might prevent 'trial unfairness' and allow the prosecution to continue.Ĭourts should not use their inherent power to stay proceedings merely to discipline the prosecution or because the court has formed the view that the prosecution was unwise. 630, CA Attorney General's Reference (No 2 of 2001) 2 A.C. The inherent jurisdiction of the court to stop a prosecution to prevent an abuse of process is to be exercised only in exceptional circumstances: Attorney General's Reference (No 1 of 1990) Q.B. From this duty there arises an inherent power to 'stay' an indictment (or stop a prosecution in the magistrates' courts) if the court is of the opinion that to allow the prosecution to continue would amount to an abuse of the process of the court. However, the courts have an overriding duty to promote justice and prevent injustice. The basic principle is that it is for the prosecution, not the court, to decide whether a prosecution should be commenced and, if commenced, whether it should continue ( Environment Agency v Stanford C.O.D.

In the same way, we are also conscious of the struggle to control the “things” our words attempt to contain and mean. In “The Shards Still Trembling,” the speaker dreams of making a lover “shudder / with the simplest words.” In “What We Know,” the speaker strives to communicate through touch: “Touch me on the shoulder / it means memory / touch me on the elbow / it means come follow.” The opening poem of this volume introduces the figure of a speech therapist, through whom we learn of the speaker’s particular and personal awareness of the way in which words are physically and figuratively formed: “How the mouth makes a moon / when we say moon.” We are always, in these poems, conscious of the struggle to contain language and make it obey the mouth, the tongue, the ear, the body. Giannelli weaves language into a latticework in these poems, raising questions about what words mean to the speaker of these poems and what it means to be able to speak and experience language. This world in which “clouds thin to their bones” and “each leaf / pried from shadow / glittering / like aspirins” lives amongst stars that “fall across the earth.” The natural world becomes, in these poems, glorious in its unwillingness to communicate the way humans do. Not unlike the speaker of Giannelli’s poems, whose interactions with the natural world are limited primarily to naming-and thereby attaching meaning to-the things of this world. In the quiet, meditative world of this collection, we are observers. What is it that we understand language to be? And how does the possession or dispossession of language change us? To go one step further, how do we catalogue our losses without first naming what we’ve lost? ![]() In the collection’s first poem, “Stutter,” we are introduced to a speaker who has lost the inherent spontaneity of speech: “since I can’t say everlasting / I say every / lost thing.” At once captivating and mysterious, the opening poem doesn’t explain, but creates more questions. What can language accomplish, in and of itself? In Tremulous Hinge, Adam Giannelli’s award-winning debut poetry collection from the University of Iowa Press, language doesn’t necessarily come in the form of speech. 1/8/2024 0 Comments Obey me select smartYou notice this and you quickly kneel beside him reaching for his hands and quickly placing it beside your face. For example, marble patterns look better when starting with a wetter shirt, and striped patterns look better on dryer shirts. Different dye patterns look better with different fixer wetness levels in the fabric. Dryer fabric yields cleaner lines and less spreading. Wetter fabric causes the dye to flow out into fabric in more feathery or marbled patterns. The dye spreads on the fabric in different ways depending on how wet the fabric is with fixer water. Instructions on common designs can be found later in this guide. Place the fixed fabric on dyeing surface and fold, twist or tie it into the pattern you want to dye. Wring out excess fixer water back into the fixer water bucket. You can reuse the fixer water and treat several batches of fabric in the same mixture. You know frankly, looking back at it now, the reason Kurt Cobain is dead is that everybody wanted the cow to produce more milk. If we were going to do a record at that point, it really would have been a strictly commercial enterprise. And I think largely we escaped putting out what both of us agree would have been either a terrible record or a record that didn’t have our hearts in it. ![]() I mean, with hindsight being 20/20, I think Nash and I could have worked things out, and been happily employed at a major label through the late ’90s into the early 2000s, but such was not to be. Our slice of territory musically became grunge, which became this in-demand thing. We didn’t really foresee what was going to happen. The process of making music together became something that was out of our control. We felt like the magic had turned into bad juju for the band, and expectations were raised beyond what we had gotten into the band. And people were dying at a rapid rate around us. And two thirds of us felt that continuing meant most likely somebody was going to die. King: Whatever salient concerns of the moment really, to be brutally honest, were life or death concerns. And enough time had gone by where we ourselves forgot why on earth we stopped being a band. We couldn’t go anywhere in Chicago without people quizzing us why on Earth we had stopped being a band. We really had a falling out where time healed all wounds. This Urge reformation thing happened in stages. The genesis of this record really is, since our reformation as a band that kind of self-destructed in the mid ’90s-at our peak I may add it was a very conscious self-destruction-we cautiously got together for a show for our friends and co-conspirators We are benefitting from it not coming out in the last three years. King: You know, that’s a good question and an obvious question. Why did it take ten years to make your new album? Their strong 2011 comeback Rock & Roll Submarine has led to their new one, Oui, out this week on Omnivore Records with its own smart cover, “Freedom” by Wham! We spoke to Nash and King over a frozen party line recently. Nash Kato and Eddie “King” Roeser led the band (with a succession of drummers so numerous it gave Spinal Tap a run for its money) but split at the heights of their popularity only to reunite in the new century. tour-they found their own moment with a delicious cover of Neil Diamond’s “Girl, You’ll Be a Woman Soon” buoyed by prime placement in Quentin Tarantino’s enduring 1994 Pulp Fiction. Running adjacent to the grunge boom-opening for Nirvana’s Nevermind tour and then Pearl Jam’s Vs. There is never a dull moment at an Urge Overkill concert, and to see them crank through their classic hits with the same amount of energy they had in the ‘90s is a pure treat.Formed 36 years ago in Chicago, Urge Overkill was an edgy garage outfit that aligned with a number of notable producers from Steve Albini and Butch Vig to Kramer and the Butcher Brothers. The band plays songs from almost all of their albums and are sure to touch on their hits like “Sister Havana” and their famous cover of Neil Diamond’s song “Girl, You’ll Be a Woman Soon”, which was featured on the Pulp Fiction soundtrack. The band did not banter much on stage, but rather cranked through their songs at a fast paced giving the audience barely anytime to know what hit them, however all the audience seemed to be thoroughly enjoying the show and never seemed to be disengaged. Nash Kato had on his sunglasses and his white denim and shook his long hair around stage while rocking out. The band had a strong stage presence when they performed. Roeser would usually hold down the rhythm with his fast chord progressions, while Kato would shred it up on the guitar. Nash Kato and Eddie Roeser had great chemistry on stage. They played the kind of college rock that was so prevalent and loveable in the early ‘90s, which included loud distorted power chords blasting in your face, and tasty guitar licks. I got the privilege to see them open up for Phoenix in 2013 and they put on a stellar performance. Since then they have been playing a few shows here and there. Urge Overkill had called it quits for a while, but they got back together in the mid 2000’s and released their first album in 16 years in 2011. Although Urge Overkill might not have received the commercial recognition that they deserved, they always have a loyal fan base that appreciates the alternative-rock music they are so great at making. They wrote catchy music in a style of their own, played high-energy performances, and even opened up for some of the biggest bands at the peak of their careers like Nirvana and Pearl Jam. Urge Overkill was one of those bands that did everything right, but somehow did not break into the mainstream. ![]() The build of the pole allows it to be light in weight so you can easily control it.
